1. Definitions
- Agreement — these Terms & Conditions, together with any booking confirmation or engagement letter.
- Hearthline / We / Us — the organisation operating under the name Hearthline at 8 Jalan Pinang, 50450 Kuala Lumpur, Malaysia.
- User / You — any individual or organisation accessing our website, enquiring about, or attending our offerings.
- Offerings — the Household Documents Orientation workshop, the Family Communication and Meeting Practice course, and the Employer and NGO Family Support Operations consulting engagement.
- Materials — printed and digital documents provided to participants during a session, including the household index, agenda templates, and referral sheets.
- Content — all text, images, documents, and other materials on our website.
2. Acceptance of Terms
By submitting an enquiry form, confirming a booking, or attending an offering, you agree to these Terms & Conditions. If you are booking on behalf of an organisation, you confirm that you have authority to bind that organisation to this Agreement.
You must be at least 18 years of age to attend our offerings. By booking, you confirm that you meet this requirement.
3. Description of Offerings
Hearthline provides education and operational consulting on household records organisation and family administrative process. Our three current offerings are described in full on our Solutions page. All offerings are general education, document organisation, and operational consulting. Nothing Hearthline provides constitutes legal, financial, psychological, counselling, or any other regulated professional service or advice.
Hearthline operates primarily in Kuala Lumpur, Malaysia. Workshop and course sessions are held at our premises or other venues in the Klang Valley area unless otherwise stated. The employer consulting engagement may involve on-site visits within Malaysia.
4. Booking and Enrolment
A booking is confirmed when Hearthline sends a written confirmation to you by email. Payment is due within five working days of the booking confirmation, unless the engagement letter specifies otherwise. Hearthline reserves the right to release a place if payment is not received within this period.
For the employer consulting engagement, the scope, timeline, and fee are set out in an engagement letter agreed in writing before work begins. The engagement letter takes precedence over these Terms in the event of conflict.
5. Payment Terms
All fees are stated in Malaysian Ringgit (RM) and are inclusive of applicable taxes unless stated otherwise. Payment is accepted by bank transfer. Fees include all printed materials provided during the session.
Cancellation and Refunds
- Cancellation more than 7 calendar days before the session date: full refund.
- Cancellation within 7 calendar days of the session date: credit toward a future session of the same type. No cash refund.
- Non-attendance without prior notice: no refund or credit.
- If Hearthline cancels a session, all fees paid will be refunded in full within 10 working days.
Cancellation terms for the employer consulting engagement are set out in the engagement letter.
6. User Responsibilities
You agree to:
- Provide accurate information when making an enquiry or booking.
- Attend sessions at the scheduled time and location.
- Treat other participants and facilitators with courtesy.
- Use materials provided by Hearthline for your own household or organisational purposes only.
- Not record any session without the written consent of all participants and Hearthline.
You must not misrepresent the nature of Hearthline's offerings, including by presenting our materials as professional legal, financial, or clinical advice.
7. Intellectual Property
All content on the Hearthline website and all session materials (including the household index template, agenda template, glossary, and boundary framework) are the intellectual property of Hearthline. Materials provided to participants are licensed for personal or internal organisational use only. They may not be sold, licensed to others, or reproduced for commercial purposes without written consent from Hearthline.
Employer clients who receive bilingual plain-language information materials as part of a consulting engagement are granted a non-exclusive licence to reproduce those materials for their own staff and members, as specified in the engagement letter.
8. Disclaimers
Hearthline's offerings are provided for educational and operational purposes only. Nothing in any workshop, course, session, material, or communication from Hearthline constitutes legal advice, financial planning, psychological or counselling support, medical advice, or any other regulated professional service.
Hearthline makes no representation that attending a workshop or course will produce any particular outcome for any participant's household or personal situation. The materials are general in nature and may not apply to every individual's circumstances.
The website and all content are provided as-is. Hearthline does not warrant that the website will be uninterrupted or error-free.
9. Limitation of Liability
To the maximum extent permitted by Malaysian law, Hearthline's liability to you in connection with any offering is limited to the fee you paid for that offering. Hearthline is not liable for any indirect, consequential, or special damages arising from your participation in our offerings or your use of our website.
Nothing in this clause limits Hearthline's liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
10. Indemnification
You agree to indemnify Hearthline against any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of Hearthline materials, or your misrepresentation of the nature of Hearthline's offerings to a third party.
11. Termination
Hearthline may decline or cancel a booking, or remove a participant from a session, if their conduct is disruptive, threatening, or otherwise incompatible with the conduct of an orderly workshop or course. In such cases, Hearthline will refund the session fee on a pro rata basis.
For the employer consulting engagement, either party may terminate the engagement on 30 days' written notice. Fees are payable for work completed to the date of termination.
12. Dispute Resolution
If a dispute arises in connection with these Terms or any Hearthline offering, the parties will first attempt to resolve it informally by written communication. If the dispute is not resolved within 30 days, it may be referred to mediation under the Rules of the Asian International Arbitration Centre (AIAC), conducted in Kuala Lumpur in the English language.
These Terms are governed by the laws of Malaysia. The courts of Malaysia have exclusive jurisdiction over any dispute that is not resolved by mediation.
13. General Provisions
- Entire agreement: these Terms, together with any booking confirmation or engagement letter, constitute the entire agreement between you and Hearthline in relation to the relevant offering.
- Severability: if any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: Hearthline's failure to enforce any provision does not constitute a waiver of that provision.
- Assignment: you may not assign your booking or rights under these Terms without Hearthline's written consent. Hearthline may assign its obligations to a successor organisation.
- Notices: formal notices under these Terms should be sent to the contact address below or by email to [email protected].
14. Changes to These Terms
Hearthline may update these Terms from time to time. Updated Terms will be posted on our website with a revised date. For existing bookings, the Terms in effect at the time of booking continue to apply unless you are notified of a material change and given the opportunity to cancel.
